General Policy for Participanticon

Please read this General Policy carefully before you start using our application, because these rules apply to your use of our application.

Effective from :  20 March 2024

When Participants (“you”, “yours”) sign up to become a Participants to Talentvis (“Talentvis Academy”, “we”, “us”, “our”, “ours”), you agree to abide by this policy ("Policy"). This Policy covers details about the aspects of our Platform (“Talentvis Academy”) relevant to you and is incorporated by reference into our Terms and Conditions, the general terms that govern your use of our Platform. Any capitalized terms that aren't defined in this Policy is defined as specified in the Terms and Conditions.


1.      Definition

1.1  Training Partner is a party that provides training and has competence and expertise in the material provided.

1.2  Client is a Company that engages with Talentvis to use Talentvis Academy platform.

1.3  Participant(S) is the employee of the Client has completed the payment for the selected course.

1.4  Platform is https://talentvisacademy.com/ site that provides training course for the participants.

1.5  Payment Gateway is a third parties that partner with Talentvis to provide payment system services.


2.      Participants Obligations

As a Participant, you are responsible for the identification data you provide including but not limited to the training courses you book and any decisions you have taken by taking courses on our Platform.


Hereby you represent, warrant, and acknowledge that:

a.      The errors in the writing of names and/or identification of Participants are not the responsibility of Talentvis, Participants must ensure that the data provided is correct and accurate.

b.      Participants must fulfil the terms and conditions of completion set by the Training Partner. Certificates will be issued to those Participants who fulfil the terms and conditions.

c.      The issuance of certificates is the sole decision of the Training Partner, Talentvis does not involved in such process.

d.      Reviews given to Training Partner must be given responsibly, in accordance with the values of anti-harassment, respect, and fairness. Talentvis doesn’t held accountable for reviews submitted by Participants.


3.      Payment Policy

The payment process is facilitated by Payment Gateway integrated with Talentvis, ensuring seamless transactions. The currencies applicable for transactions will adhere to the regulations of the respective countries involved. You can make payments on the Talentvis Academy Platform as follows:

a.      Prior to making a payment, Participants must get approval for the course from Client, then the Client will proceed to make the payment within the Platform using the designated Payment Gateway.

b.      You can choose your preferred payment method from options including cards or bank transfer via virtual account.

c.      Once the payment is completed, the Platform will automatically generate a receipt for your records.

d.      The Client, who will then proceed the payment using Payment Gateway.

e.      Talentvis does not guarantee seat availability until payment has been fully made.

f.       If the Participant is no longer employed by the Client, the Client must provide notification within seven (7) days of the Participant's resignation.



4.      Privacy Policy

Talentvis and the Training Partner may record, photograph, and take pictures of the training activities for their documentation and/or marketing purposes. Further details on how we protect your personal data can be accessed through our Privacy Policy.

 

5.      Tax Obligations

If the Participant purchases a product or service in a country that requires us to remit national, state, or local sales or use taxes, value added taxes (VAT), or other similar transaction taxes ("Transaction Taxes"), under applicable law, we will collect and remit those Transaction Taxes to the competent tax authorities for those sales. We may increase the sale price at our discretion where we determine that such taxes may be due. For purchases through mobile applications, applicable Transaction Taxes are collected by the mobile Platform (such as Apple's App Store or Google Play). Please note that the price paid by the Participants already includes tax.


6.      Refunds / Cancellation

We do not provide refunds in the form of cash. In the event of course cancellation or rescheduling by the Training Partner or the Participant, the Participant may choose to take the same course or another course in the future. However, if the price of the course to be taken is higher than the price of the previous course, the Participant shall be liable to pay the shortage.. Any payment made for a cancelled or rescheduled course will be credited to the Participant's account within  seven (7)  working days, with the credit balance valid for one (1) year; after this period, the participant must pay according to the latest course fee. Refunds will not be given if participants are unable to attend the course. Participants may reschedule or cancel their attendance with a minimum of fourteen (14) days' notice without incurring penalty fees.


7.      Ownership and Intellectual Property

Training materials that are prepared by the Training Partner and are considered the intellectual property of the Training Partner. Participants are prohibited from sharing, disseminating, copying, duplicating, and/or reproducing Training Partner's materials without permission from the Training Partner.

 

8.      Force Majeure

In the event either party is unable to perform its obligations under the terms of the Agreement and policies because of acts of God, strikes, equipment or transmission failure, or damage reasonably beyond its control, or other causes reasonably beyond its control, such party shall not be liable for damages to the other for any damages resulting from such failure to perform or otherwise from such causes.

 

9.      Translations

Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will take control if there is any conflict.


10.  Modifications

We may update this Policy from time to time to clarify our practices or to reflect new or different practices. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless states otherwise.
